Terms Of Service
1. Overview
By ordering or using any service from Jessop's Hosting, you agree to the following Terms of Service and Service Level Agreement. These terms apply to all customers and services unless otherwise agreed in writing.
2. Service Commitment
We aim to provide stable and uninterrupted service. However, service uptime is **not guaranteed**.
Downtime Credits
If a server experiences more than 1 hour of unplanned downtime due to a fault on our end, customers may contact us to request account credit equivalent to the lost time. This is offered in goodwill, and is not a contractual entitlement.
Downtime credit will not be granted for outages resulting from:
- Customer configuration changes or software errors
- Network issues, attacks, or downtime outside our control
- Abuse, suspension, or violation of acceptable use
This does not cover indirect loss such as data loss, business disruption, or third-party costs.
3. Refunds & Cancellations
By ordering, you agree to immediate provisioning and waive your 14-day cancellation right under the Consumer Contracts Regulations.
If you choose to cancel your service, it will remain active until the end of the current billing period, after which it will terminate automatically.
3.1 Billing & Non-Payment
All services are billed in advance. If payment is not received by the due date, the service will automatically suspend and terminated after 7 days unless prior arrangements are made.
4. Acceptable Use
You must use our services in a lawful and responsible manner. The following are strictly prohibited:
- Cryptocurrency mining, plotting, or farming
- Scanning or probing of foreign IPs or networks
- Changing MAC addresses manually
- Using spoofed or fake source IPs
- DDoS attacks or denial-of-service behavior
- Operating open mail relays
- Sending spam or unsolicited communications
- Hosting or distributing malware, phishing pages, or other harmful software
- Publishing illegal, obscene, defamatory, or otherwise harmful content
Violation of these rules may result in immediate suspension or termination without notice and without refund.
4.1 Fair Use
While we offer generous resource allocations, use that negatively impacts other customers may result in throttling or service adjustment. We aim to provide fair access to all users. This only applies to "free" resources that you do not pay for a specific amount of. For Example but not limited to network bandwidth.
Use of automated tools (such as uptime monitors or status bots) must not generate excessive traffic or interfere with normal operations.
5. Responsibility of Use
- You are solely responsible for the security, content, and legality of the data and services you host.
- You must not operate your services in a way that disrupts other users, networks, or third parties.
- You must regularly back up your own data. We are not responsible for any data loss, regardless of cause.
- You agree to re-upload or restore any data you lose at your own expense.
- You remain fully responsible for ensuring that your use of our services complies with applicable UK, international, and third-party regulations, including GDPR, the Telecommunications Act, and intellectual property laws.
6. Content Restrictions
You agree not to upload, publish, or link to content that:
- Infringes the rights of others, including copyright, trademarks, and personal data
- Is pornographic, obscene, defamatory, hateful, extremist, or illegal
- Targets children inappropriately
- Promotes violence, gambling, or criminal activity
We reserve the right to restrict content that, while not illegal, we consider high-risk or reputationally harmful.
Violations may result in immediate service suspension or termination and legal liability.
7. Data Protection & Privacy
We comply with applicable data protection laws, including the UK GDPR and the Data Protection Act 2018. However, you are solely responsible for ensuring your own compliance with these laws when storing, transmitting, or processing personal data using our services.
Jessop’s Hosting operates solely as an infrastructure provider. We do not access, manage, or make decisions about the personal data you or your end users process. Accordingly, Jessop’s Hosting does **not** act as a data controller or data processor in relation to any personal data that you or your customers may handle through our services.
You are considered the data controller (or data processor, where applicable) for any personal data you process via our platform, and you retain full responsibility for all related legal obligations.
7.1 Your Responsibilities Regarding Data Protection & Privacy
If you handle personal data on behalf of third parties, the following applies when using our services:
- You are the data controller (or processor, if applicable) for any personal data stored or processed using our services.
- You are fully responsible for complying with all relevant data protection laws, including the UK GDPR.
- We maintain reasonable infrastructure security, but we do not guarantee the security of data transmitted over the internet.
- You are responsible for securing your systems and data against unauthorized access, data breaches, and misuse.
8. Legal Compliance
You are obligated to:
- Comply with all applicable laws, including content, competition, and privacy regulations.
- Indemnify us against any legal claims, costs, or damages resulting from your misuse or illegal use of our services.
- Remove any illegal or non-compliant content immediately upon request.
9. Liability
- Services are provided as-is, with no warranty of uninterrupted operation, merchantability, or fitness for purpose.
- Jessop's Hosting shall not be liable for loss of data, business, or any indirect, incidental, or consequential damages.
- Our liability is strictly limited to the amount paid for the current service period, and only if fault is solely ours.
9.1 Force Majeure
We are not liable for delays or failures in performance due to events beyond our reasonable control, including but not limited to acts of God, government actions, natural disasters, or internet outages.
10. Account Suspension or Termination
We reserve the right to suspend or terminate services at any time in response to:
- Abuse, violations, or non-compliance with these terms
- Requests from legal authorities
- Threats to infrastructure, network stability, or other customers
We reserve the right to take immediate action, including suspension or termination, in cases of severe abuse, security threats, or legal breaches. Where appropriate, we will issue a warning or explanation.
10.1 Law Enforcement & Abuse Reports
We cooperate with law enforcement where legally required. If your service is involved in illegal activity or receives abuse reports, we may investigate and take appropriate action, including temporary suspension, with or without notice.
11. Account Ownership
The registered billing contact is considered the account owner. We may request proof of identity for account changes or ownership disputes. It is your responsibility to maintain access to your billing email. It is the account owners responsibility to secure their account, any abuse caused by a breached account will be considered the action of the account owner. Furthermore this includes any sub accounts the account owner grants access to their account.
12. Support Scope
We provide best-effort support for service availability and hardware/network issues. Support does not include software configuration, third-party troubleshooting, or code-level debugging unless explicitly stated.
13. Termination of Services
We reserve the right to discontinue services with 30 days’ notice. In the event of business closure or sale, you will be informed and given time to transfer your data.
If we terminate service without cause, a pro-rated refund may be issued at our discretion.
14. Governing Law
This agreement is governed by the laws of the United Kingdom. Any disputes shall be resolved in the UK courts.
15. Intellectual Property
You retain full ownership and rights to any data or content hosted using our services. We do not claim any rights to your material beyond what is required to provide the service.
16. Reselling Services
You may resell our services only with express written permission. As a reseller, you are responsible for ensuring your customers comply with all applicable sections of this Terms of Service and Acceptable Use Policy.
We do not provide direct support to your end users. All abuse, billing, and support requests must come from the primary account holder. You remain fully liable for the behavior and use of any sub-clients or downstream users operating under your account.
Violation of these terms by any of your customers may result in suspension or termination of your reseller access.
17. Changes
These terms may be updated periodically. Significant changes will be announced via your client portal or registered email. Continued use of our services after changes constitutes agreement to the updated terms.

19. Affiliates
Jessop’s Hosting offers an affiliate program that allows customers to earn service credits when referring new customers.
Customers may register for an affiliate link through their account.
If a new customer makes a purchase using your affiliate link, and the purchase occurs within 7 days of their last click on your link, you will receive 25% of the order value as credits.
Only the most recently used affiliate link is eligible for commission.
Credits are applied to your Jessop’s Hosting account after the purchase is confirmed.
Credits have no cash value, cannot be withdrawn, and may only be redeemed against services provided by Jessop’s Hosting.
We reserve the right to withhold or reverse credits in cases of abuse, fraud, self-referrals, or cancellations/refunds of the qualifying order.
Jessop’s Hosting reserves the right to modify, suspend, or terminate the affiliate program at any time without prior notice.
